1. Introduction

Sales and deliveries made by GTR Autoparts are subject to these general terms, unless otherwise expressly agreed in writing and signed by both parties, in which case that agreement shall prevail over these terms.

2. General

Using this website and/or registering as a user implies acceptance of these terms.

3. Ownership of this website

This website is owned by Solaris Global S.L. All rights to its content (images, texts, design and software) belong to Solaris Global S.L. All elements of this website, including without limitation its design and content, are protected by intellectual property and industrial property law and by international copyright treaties.

4. Use of the content

Unless expressly authorised by GTR Autoparts, the content of this website may not be reproduced, transmitted or exploited in any way.

5. Liability

5.1. GTR Autoparts makes every effort to ensure the accuracy of the content of the website, although it may occasionally contain errors or inaccuracies.

5.2. GTR Autoparts accepts no liability for the content of third-party websites linked from this site.

5.3. GTR Autoparts shall not be liable for damage or loss arising from the use of this website, except where consumer and user protection law mandatorily provides otherwise.

5.4. Users shall compensate GTR Autoparts for any damage or loss arising from a breach of these terms or from unauthorised use of the content of this website.

6. Severability

If any provision of these terms is found to be void or unenforceable under the applicable law, that invalidity shall not affect the remaining provisions, which shall remain fully valid.

7. Governing law and jurisdiction

These terms are interpreted and governed by the Spanish law in force, in particular: the Consolidated Text of the General Law for the Protection of Consumers and Users (Royal Legislative Decree 1/2007), as amended by Law 3/2014 (which transposed Directive 2011/83/EU on consumer rights) and by Royal Decree-Law 7/2021 (which transposed Directives (EU) 2019/770 and 2019/771 on contracts for the supply of digital content and for the sale of goods); Law 34/2002 of 11 July on Information Society Services and Electronic Commerce; the Civil Code; Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and the guarantee of digital rights, as regards the processing of personal data; and any other applicable law and its implementing regulations. Any dispute arising from these terms shall be submitted to the courts of Collado Villalba (Madrid), without prejudice to the consumer’s right to go to the courts of their own place of residence where consumer law so provides, and without prejudice to the right of GTR Autoparts to bring proceedings before another competent jurisdiction where appropriate.

8. Returns and right of withdrawal

For customers who are consumers (natural persons acting for purposes outside their trade or profession), GTR Autoparts recognises the right of withdrawal under the terms of the Consolidated Text of the General Law for the Protection of Consumers and Users (articles 68 to 79 and 102 to 108). Period: customers have 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to give any reason. Exception, personalised products: in accordance with article 103.c) of that law, products made to the customer’s specifications or clearly personalised are excluded from the right of withdrawal. In particular: forged wheels made to order for a vehicle and/or with a specific finish requested by the customer cannot be returned; flow-formed (semi-forged) wheels cannot be returned either when they are made to order for a specific vehicle and/or finish requested by the customer. Before a purchase of a personalised product is completed, the customer will be expressly informed that the product carries no right of withdrawal. Effects of withdrawal (non-personalised products): in the event of a valid withdrawal, GTR Autoparts will refund all payments received from the customer, including standard delivery costs (unless the customer expressly chose a delivery method other than the least expensive one, in which case only the latter will be refunded), within a maximum of 14 calendar days from notification of the decision to withdraw. GTR Autoparts may withhold the refund until it has received the returned goods or until the customer has provided proof of having sent them back, whichever is earlier. The customer must return the product without undue delay and in any event no later than 14 calendar days from notifying the decision to withdraw. The direct costs of returning the product are borne by the customer. The customer is liable for any diminished value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning. The customer may exercise the right of withdrawal using the model form available on request from info@gtrautoparts.com, or by any other unequivocal statement addressed to GTR Autoparts. Business customers (dealers / purchases for a business or professional activity): purchases made by customers acting in the course of their business or profession are not subject to the consumer protection rules described in this section. Cancellation and return conditions, and any surcharge applicable to these customers, will be expressly agreed in each case.

9. Changes

GTR Autoparts reserves the right to modify and update, at any time and without prior notice, the information on the website, its configuration and presentation, the conditions of access and of contracting, etc. All products, descriptions and prices are valid except for typographical errors.

10. Warranties

All new products sold by GTR Autoparts to consumers carry the legal guarantee of conformity of 3 years from delivery, in accordance with the Consolidated Text of the General Law for the Protection of Consumers and Users (article 114 et seq., as amended by Royal Decree-Law 7/2021). During the first 2 years from delivery, any lack of conformity that becomes apparent is presumed to have existed at the time of delivery, unless proven otherwise or unless that presumption is incompatible with the nature of the product. In addition, and never as a substitute for the legal guarantee above, the manufacturer of certain products may offer an additional commercial warranty of 12 months against manufacturing defects, subject to each brand’s own conditions. To claim under this additional commercial warranty, the fitting invoice from a specialist workshop may be required. In no case does the warranty (legal or commercial) cover defects resulting from incorrect installation or improper use of the product. Transport costs needed to make a warranty claim shall be borne by the customer when the repair or replacement requires sending the product to the factory, unless the lack of conformity is attributable to GTR Autoparts, in which case GTR Autoparts shall bear those costs.

11. Prices and product availability

Prices and product availability are valid while stocks last and except for typographical errors. All prices shown at GTR Autoparts include VAT. Orders are handled strictly in the order in which they are received. If the item is in stock, it ships within 24-48h; if the product is made to order, the estimated delivery time is approximately 5 to 25 days, for guidance only and not binding, depending on the manufacturer. If an ordered product is out of stock, the order will be cancelled after notifying the customer, unless the customer prefers an alternative product with similar characteristics or a refund. Product photographs are for illustration only and do not constitute a binding contractual commitment; colour, finish or shape may vary depending on the vehicle model or the product specifications.
